CMJ University case: Guv asks state govt to hand over investigation to CBI Shillong: A day after calling for dissolution of the controversial Chandra Mohan Jha University, Meghalaya Governor Ranjit Shekhar Mooshahary on Friday recommended to the state government to "transfer" the present investigation into the entire controversy to the CBI.

Mooshahary, in a letter through his principal secretary MS Rao this evening, suggested transferring the present investigation, which is being carried out by the state CID, to the CBI stating that\"in case the state CID is finding it difficult in view of the extensive ramifications of the case.\" Forty-five days have passed, yet the CID of the state police has not been able to make any breakthrough in investigating the case even as it could only arrest four officials of the varsity while failing to track the absconding owner and chancellor, Chandra Mohan Jha.

Earlier, the Governor, also the Visitor of the University, had pulled up the varsity for a number of irregularities, mismanagement, mal-administration, indiscipline and criminal liability prevalent in the private university.
Besides suggesting for a CBI inquiry, the Governor has also made more suggestions to the state government, including to file a police complaint against the University for fraudulent withdrawal of the endowment fund amounting to Rs 2 crore that was meant to finance a portion of the operating or capital requirements of the institution.
It was also revealed that Jha allegedly kept the money for two days so that he could get a bank statement and produce it before the Government as security money.


Concerned over the plight of the students enrolled with CMJ University since its inception in 2010, the Governor also suggested that state government start functioning of the Captain Williamson Sangma Technical University as early as possible so that the affected students could be given fresh options depending on their suitability.
Meanwhile, dissolution of the CMJ University will be final once the cabinet sits even as the State Regulatory Board for Higher Education has accepted the recommendations of the Governor.
Mooshahary on Wednesday had asked the State Government to consider the closure of the University in accordance with Section 48 of the CMJ University Act, 2009.

Meghalaya Governor R.S. Mooshahary Wednesday asked the state government to dissolve the controversial CMJ University.From established facts, it was clear that there has been mismanagement, mal-administration, indiscipline and failure in the accomplishment of the objectives of the university, apart from criminal liabilitysaid Mooshahary, who is also the visitor to the private varsity.The state government is accordingly being addressed to consider dissolution of the CMJ University in terms of Section 48 of the CMJ University Act, 2009,\" he added.The Criminal Investigation Department (CID), investigating the alleged lapses of CMJ University, unearthed a number of irregularities in the university\\\\\'s functioning. It arrested the varsity\\\'s registrar, Mrinal Kanti Deb, deputy registrar Premlal Rai, university director Manjeet Kaur, and human resource manager Juban Kharpuri on charges of fraud and cheating.However, the CID sleuths have not been able to arrest varsity chancellor Chandra Mohan Jha, as he has gone into hiding ever since Mooshahary exposed the irregularities of the varsity.On Monday, the University Grants Commission (UGC) constituted a nine-member expert committee headed by Tezpur University Vice Chancellor Mihir K. Chaudhury to look into alleged irregularities committed by the private university.The university was established by an act passed by the state legislature in 2009 while it started functioning from October 17, 2010. It is alleged to have issued a large number of fake PhDs.CMJ University had been running distance education centres outside the state, in other parts of the country as well as in some centres abroad, in breach of University Grants Commission regulations and guidelines. Fake Degrees and Admissions by CMJ UniversitySir,Chandra Mohan Jha University, popularly known as CMJ University, is a private university established through a State act called as “CMJ University Act, 2009” in the State of Meghalaya. In a letter written by UGC to the self appointed Chancellor of the University, Shri C.M. Jha on November 10, 2010 informed that no off campus centre(s) is opened by the University outside the territorial jurisdiction of the State. In case, the University has already started any off campus outside the State, it must be closed immediately. At the same time, even in the official website of the University, www.cmjuniversity.edu.in gives wrong misleading information to the students. One announcement in the website says, “The University does not have any Off Campus/Study Centres. If anyone is claiming to be a study center of CMJ University, it is false and it should be reported to us. Suitable reward will be given”. And also “CMJ University conducts only Regular courses at its campuses located in Meghalaya and does not offer any correspondence or distance course”.There have been questions in view of the above points, how CMJ University is running different study centres in different parts of the country including Manipur. They are also charging huge amount of money from the students. For example, for a PhD programme, a student has to pay around Rs 1,50000/-through their “agents” (so called academic counsellors) in installments. Many students from Manipur enrolled in this University in different academic programmes including PhD Programme and as well as already awarded PhD Degrees to many students.Today, CMJ University has come under the scanner of Meghalaya Governor, R.S. Mooshahary, who is also the Visitor of the University. The Governor on Tuesday, April 30, 2013, directed the university that no fresh admission of students shall be undertaken by the CMJ University till the appointment of a Chancellor. Mooshahary issued a series of directions to the CMJ University and asked them to submit a fresh proposal for the appointment of a Chancellor and withdraw all the degrees awarded so far.Taking strong note of the drawbacks of the University, the Governor has asked the University to submit a compliance report within May 21, 2013. In the directive issued to the Chairman of the CMJ Foundation, Chandra Mohan Jha, the Governor was of the view that the Chancellor appointed by the University does not have the approval of the Visitor, which is illegal and is in violation of the CMJ University Act, 2009.According to letter of the Governor, the CMJ University has so far enrolled as many as 2734 students in 2012-2013, 469 in 2011-2012 and 176 in 2010-2011 in various courses. The Governor directed the University to recall and withdraw all the degrees awarded so far and publish this fact in national and local dailies at their own cost. He also pointed out that the University has awarded Ph.D degrees to 434 students during 2012-2013 and has enrolled 490 students for the Ph.D programme during 2012-2013 with only 10 teachers with Ph.D qualification. These enrolments and award of Ph.D degrees are in contravention of the UGC (Minimum Standards and Procedure for Awards of M.Phil/Ph.D degree) Regulation, 2009. The CMJ University has also been directed to frame rules and procedures for admission into the M.Phil and Ph.D degree programmes, allocation of supervisor, course work, evaluation, assessment and other related matters in accordance with the UGC Regulation.The Governor’s Secretariat has filed an FIR against the CMJ University for the alleged fraud in awarding fake degrees and admissions. Armed with a court order, CID sleuths have also sealed the CMJ University at Laitumkhrah, Shillong on Thursday night. CID has started investigation into the affairs of the CMJ University after the Governor’s Secretariat filed a case against the University. Experts from the forensic department also assisted the CID. Chaos in CMJ University, students demand answers

SHILLONG, May 01: Confused and worried students of the CMJ University on Wednesday asked the university authority to immediately clarify after the Meghalaya Governor RS Mooshahary directed the University Chancellor to withdraw all the degrees given by the institute and also stop admission because of various anomalies in its functioning.
Students from Jaintia hills also gheraoed the University center in Jowai after the news broke out.

The CMJ University on Wednesday wore a chaotic look while the students did not attend the classes.

A first year MA student from Arunachal Pradesh in the university said, “We demand immediate answers from the authority including the Chancellor CM Jha on the Governor’s order as it is of serious concerns to us and our career.”
Mentionably, on Tuesday, the Governor, who is also the university’s Visitor, issued an order to the CMJ University to recall and withdraw all degrees awarded so far and also submit a fresh proposal for the appointment of the Chancellor and submits its compliance report within May 21.
The student said that the CMJ University told the students that the order will not affect them but only those who are seeking new admission.

He said, “We are in absolute dilemma whom to believe and what not to believe as it concerns our education as well as career and if the university is shutdown we are doomed.”
Another student seemed to confirm the fear that the degrees given by the CMJ University are not recognized by the government as he revealed that some of their seniors from Arunachal Pradesh who have graduated from the University had informed him that the certificates issued to them by the University has been rejected by the government.
He said, “We don’t know how far this is true and that is why we want the authority of the institute to clarify on the Governor’s order.”

The student, who is in second year said, “We felt very bad as we keep on hearing a lot about such controversies relating to the university and we don’t know what is going to happen next.”
He rued, “Our dreams have been shattered.” However, allaying fears of the students, CMJ University Deputy Registrar Dr Prem Lal Rai told reporters that the classes will continue but ‘fresh’ admission will not be taken.
Dr Rai claimed that as far as the proposal for appointment of Chancellor is concerned, the university had submitted the letter to the Governor thrice since 2009 and said that the University did not get any response from the Governor’s office.
Dr Rai also asserted that none of the degrees offered by the university are fake as they are all recognized and approved by the University Grants Commission (UGC).

Claiming that the CMJ University is not functioning illegally and recognized by the UGC, he said, “We will also be going to take the matter to the Court.” SHILLONG: Union minister for human resources development M Pallam Raju said the University Grants Commission (UGC) should list a Shillong-based Chandra Mohan Jha (CMJ) University on its website for selling over 400 fake PhD degrees all over the country and even abroad.\"As things stand, all that the UGC can do is list it (CMJ University) on its website, stating that this is a university of disrepute and has been giving fraudulent degrees, " Raju told reporters after attending the golden jubilee of the science department in the Shillong College here on Friday. SHILLONG: Chief Secretary WMS Pariat on Tuesday offered to accommodate the students of CMJ University in other educational institutions in the State provided the data containing information of students, lost during the office vandalism, is retrieved.Pariat made this offer on Tuesday when the students of CMJ University accompanied by members of the Khasi Students’ Union (KSU) met him to discuss issues pertaining to the fate of the students of the University.“The Chief Secretary assured us that the issue would be taken up with the Education department and since officials of the CMJ University are in the custody of the police, it will not take time for them to retrieve the data,” KSU educational secretary Donald Thabah told reporters after the meeting.During the vandalism at the University’s office in the city and the destruction of computers, important data of the students have been lost due to which the government is incapable of accommodating the students in other universities.It may be mentioned that the records and data were destroyed by a data entry operator of the University, Kamlesh Kumar Chowrasia, who had acted at the behest of the CMJ Director, Manjeet Kaur.“We are not concerned about the management and mismanagement of the University but the government should find a solution to ensure that the academic future of the students are not hampered and disrupted,” Thabah said.The KSU has also demanded full reimbursement of tuition fees of the struggling students of CMJ University.
Read more at http://www.theshillongtimes.com/2013/05/22/govt-awaits-lost-records-from-cmj-university/#Hr3MiICzcF9mGFe7.99 SHILLONG: In a fresh directive to the CMJ University, Governor Ranjit Shekhar Mooshahary has asked the University to comply with papers, norms and procedures by June 10 even as the Governor directed the University to refund all the fees charged, together with interest to the students within 15 days of intimation of the students.“The irregularities and violations clearly amount to mismanagement, mal-administration and failure in the accomplishment of the objectives of the University which attract the provisions of Section 48 of the CMJ University Act, 2009, relating to Dissolution of the University,” Mooshahary said in a representation submitted to CM Jha on Friday.He pointed out that it is unfortunate that the University through its legal representative has chosen to launch a tirade against the Visitor (Mooshahary) who is making sincere efforts to ensure adherence to the norms of quality education by insisting on corrective measures.“Problems do not disappear by denials nor can they be resolved by misrepresentations,” the Governor commented.He further stated that it was a matter of grave concern that the activities of CMJ University have brought discredit to the institutions of higher learning in the State and lowered the image of Meghalaya besides putting the future of students at stake.“All these adverse actions have eroded the credibility of CMJ University and have shaken the very foundation of its ability to function to achieve its goal of dissemination of higher education,” Mooshahary said.According to him, the University has not furnished the Annual Accounts, the Balance Sheet and the Audit Report to him as the Visitor of the University which has been clearly specified in Section 46 (4) of the CMJ University Act, 2009.Informing that the Shillong Engineering and Management College run by the University was de-affiliated by NEHU with effect from the academic session of 2011-2012, Mooshahary said that the college continues to take admissions by misleading the students that the degrees will be issued by the CMJ University.The Governor directed the University to refrain from issuing misleading advertisements in the print and electronic media in the interest of the student community.Mooshahary rued that the University has awarded PhD degrees to more individuals in addition to the list of 434 persons adding that the persons who have been awarded the PhD degrees include Bimlesh Kumar Gupta (Punjab), Prof. Venkatesh T Gaddime (Maharashtra) and Lahanya Lahkar, Neetu Basumatary, Achyut Chandra Das, Nagendra Boro, Abu Taleb Ahmed, Gias Uddin Ahmed, Santosh Kumar Sarma, Prasanta Pathak, Khanindra Das, Shona Ullah, Dilip Kumar Baruah, Hari Prasad Kalita, Mukut Khan, Pranab Das, Bibhuti KaIita, Nurul Islam Chakdar and Guptajit Pathak (all from Assam).“The list of PhD guides provided to this office is misleading. Initially a list of 346 guides as approved by the Faculty Research Committee of CMJ University was provided and subsequently changed,” he said, adding that when he asked for the addresses of the guides for the students who have been awarded PhD, a fresh list of 85 guides was sent.“We have also received information that some guides in the second list have denied having given their consent,” Mooshahary said.The Governor directed the University to furnish a fresh list of PhD scholars enrolled and PhD awarded separately with full address and telephone numbers and the amount of fees paid to each.He also pointed out that the CMJ University is running several off campus centres outside Meghalaya which is not permissible under the UGC (Establishment of and Maintenance of Standards in Private University) Regulations, 2003, and the decision of the Supreme Court (2005) in the case of Prof. Yashpal & another versus State of Chhattisgarh & others.Moreover, the CMJ University is offering distance education programmes outside the boundaries of Meghalaya and outside India.“These actions are in gross violation of UGC Regulations and guidelines. They also are contrary to the provisions of Meghalaya Private Universities (Regulation of Establishment and Maintenance of Standards) Act, 2012,” he said.It may be mentioned that the High Court had earlier upheld the Governor’s direction to CMJ University and had told the legal counsel representing the University that the ‘Court sees no legal infirmity in the actions of the Visitor( Mooshahary)’.Meanwhile letters are being sent to the Government of Meghalaya and to Governor Mooshahary by concerned parents and guardians from different parts of the country.A letter sent by a parent from Chennai of which this newspaper has a copy says, “The CMJ University brokers are very active in Chennai and Bhubaneswar. They are giving Ph.D degrees within 2-3 months by taking huge amounts of money. The amount demanded for Ph.D in Engineering discipline is a minimum of Rs 4-5 lakh.The letter points out that many faculty of private engineering colleges in Chennai have Ph.D degrees from CMJ University.“I had informed UGC, AICTE, CBI etc., months ago but no one took any action. In Chennai the brokers have earned crores of money by doing this business and nearly 200 faculties of private engineering colleges in Tamil Nadu have a PhD degree from CMJ University. Thanks to the Governor of Meghalaya for his action against such type of malpractices and for saving the nation from great educational damage,” the writer says.

However, founder and self-appointed Chancellor Chandra Mohan Jha (after whom the institution is named), is missing.A statement issued by the UGC said the committee would inquire into issues in their entirety. “Students and the general public are hereby informed that His Excellency the Governor of Meghalaya, in his capacity as Visitor, has initiated certain actions against CMJ University [private university], Shillong [Meghalaya] for irregularities committed by it,” the statement said.During his visit to Meghalaya last week, Human Resource Development Minister M.M. Pallam Raju said: “As things stand, all that the UGC can do is list it [CMJ University] on its website, stating that this is a university of disrepute and has been giving fraudulent degrees.”

Shillong, April 30: The fate of students pursuing higher studies in the privately-run CMJ University in the state appears to be hanging in the balance as Meghalaya governor R.S. Mooshahary has brought out various irregularities in the functioning of the university.Mooshahary is also the visitor of the university, which was established through an act passed by the Meghalaya Assembly in 2009.In a letter addressed to Chandra Mohan Jha, chairman CMJ Foundation, M.S. Rao, principal secretary to Mooshahary, raised several points on the irregularities in the functioning of the university.“I am directed to state that on perusal of the records and information submitted by CMJ Foundation on the CMJ University, irregularities have been observed,” Rao said in the letter today.The chancellor of the university appointed by the sponsor does not have the approval of the visitor, Rao said, adding that this was in violation of Section 14 (1) of the CMJ University Act, 2009.“Consequently, all further actions of the CMJ University resulting from the appointment of the chancellor are illegal and void ab initio,” he stated. In the proposal submitted for appointment of the chancellor by CMJ Foundation in 2009, the bio-data of the recommended candidate — Chandra Mohan Jha — was enclosed stating that, “he is the director of a number of colleges within and outside Meghalaya, without clearly indicating their university affiliation”.“One of these colleges, the Shillong Engineering and Management College, was de-affiliated by Nehu with effect from academic session 2011-2012,” Rao added.He said the university has enrolled students in various courses. In 2010-11, 176 students were enrolled, in 2011-12 469 students and in 2012-13 2,734 students. “But all the above admissions are illegal,” Rao stated. The principal secretary said the university has awarded PhD degrees to 434 students during 2012-13 and enrolled 490 students for the PhD programme during 2012-2013. “On the other hand, the university has only 10 teachers with PhD. These enrolments and awarding of PhD degrees are in contravention of the UGC Regulation, 2009,” he added. At the same time, Rao said the university had issued a false and misleading newspaper advertisement on April 22, 2013 claiming that it had not yet awarded PhD degree to any of the students enrolled from Assam. “On the other hand, this office has reliable information that the CMJ University has awarded PhD degrees to candidates from Assam,” he said.The university has also not submitted the annual reports to the visitor in violation of Section 45(3) of the act, he said adding that the university has acted in contravention of Section 52 of the act in respect of maintenance of standards and other related matters applicable to private universities. Hence, he said, the governor, being the university’s visitor, has issued directions to it for immediate compliance.These include:The CMJ University shall recall/withdraw all the degrees awarded so far and publish this fact in national and local newspapers at its own cost.The CMJ Foundation shall submit a fresh proposal for appointment of the chancellor along with the correct bio-data of the candidate recommended and with supporting documents.The university shall frame rules and procedures for admission into MPhil and PhD degree programmes, allocation of supervisor, course work, evaluation, assessment and other related matters, in accordance with the UGC Regulation, 2009.No fresh admission of students shall be undertaken.by the university till compliance of the above instructions and till the appointment of the chancellor in accordance with Section 14 (l) of the act.Jha has been given time till May 21 to comply with the above directives and submit a compliance report to the visitor.

SHILLONG: Accusing the Governor Ranjit Shekhar Mooshahary of twisting facts to show the CMJ University (CMJU) in poor light, the Chancellor of the university, Chandra Mohan Jha, on Saturday submitted a clarification to the Education Minister RC Laloo refuting the allegations levelled against the university.

The legal advisor of Chandra Mohan Jha (CMJ) Foundation, SP Sharma, submitted the clarification on behalf of CM Jha.

The Governor, who is also the Visitor of CMJU, had sought for the dissolution of the university in the interest of maintaining of proper standards of higher education in the State. The State Regulatory Board for Higher Education also accepted the recommendations of the Governor for closure of the University.

Moreover, Mooshahary had on Friday suggested the State Government to transfer the investigation into the CMJU anomalies to the CBI in case the State CID is finding it difficult to handle the probe in view of the extensive ramifications of the case.

\"Most of the allegations (of the Governor) are unfounded and completely devoid of truth and some of them are just perceptions and opinions of the Visitor which he erroneously mentions as established facts,\" CM Jha said in the representation made to the Education Minister.

According to Jha, the Visitor had deliberately omitted certain facts from media and selectively chosen to display only issues designed to damage the reputation of the university.

With respect to the withdrawal of endowment fund amounting to Rs 2 crore, Jha clarified that \"the university already has an endowment fund of Rs 565 lakh with it, details of which has been provided to the State Government, the UGC and the Visitor.\"

Meanwhile, addressing a press conference here on Saturday the legal adviser of CMJ Foundation alleged that the Governor is \"trying to be the complainant, the investigator and the judge in the case at hand.\"

\"How can the university be dissolved before the investigation of the CID is over,\" he questioned.

Reacting to a query on why the Chancellor of the university is not surrendering before the authorities, Sharma said that he would advise Jha to cooperate with the law enforcing agencies.

Sharma also alleged that certain rival universities, particularly from Assam, may be issuing fake certificates and instigating the entire controversy against CMJU.

\"No off-campus of the university has been set up in India although

scounselling centres are functioning,\" he said.

When asked about the qualification of Chandra Mohan Jha, he said that he is an MA even as he claimed that qualification does not matter for a chancellor.

It may be mentioned that University Grants Commission (UGC) has constituted a nine-member committee for the inspection of CMJU.
